Apple rubber-banding patent claim against Samsung wasn’t valid – US Trademark research

We have been seeing a patent fight between Apple and Samsung since Samsung release touch-based  smartphones and tablet, Apple has won of a rubber-banding patent (Patent No, 7,469,381) against Samsung and Samsung gave $1billion to Apple for this fight but this key player may not be true as Apple had hoped. Court has got claims to be valid and they said that all Samsung smartphones had infringed upon it, but now a review of the patent case over Samsung vs. Apple by the United States Patent and Trademark Office has declared that Apple’s all claims aren’t valid.

They declared interesting facts about the fight, their finding tells that Apple’s 7,469,381 patent lacks novelty and obviousness based on findings within PCT Publication No. WO 03/081458 held by AOL/Luigi Lira. However this decision to invalidate Apple’s 7,469,381 patent is still tentative.

However it doesn’t mean that the Korean company with not share the information with Judge Koh in a late-night filing any more. These results could have a huge impact on the outcome of this fight for the future. But guys what do you think, what effect this new finding show on the rivalry?
